Terms and Conditions
Object
This document aims to regulate the conditions of access and use of the Online Store of the company “Proper Hotels Portugal, Lda.”, with the internet address (www.vilabelawines.pt), and headquarters at Rua do Chantre 80, 4465-780 Leça do Balio, parish of Leça do Balio, municipality of Porto, NIPC 516 942 450, and with a share capital of €50,000.00 (fifty thousand euros), hereinafter referred to as the company.
By purchasing any product in the aforementioned store, the user is bound by the provisions of this document.
The user is required to be of the legal minimum age for the consumption of alcoholic beverages.
The online store is limited to Portuguese territory.
Product, Price and Content Information
The company reserves the right to change these Terms and Conditions at any time and without prior notice.
The images/photographs of each product may not exactly match the delivered product.
In case of stock shortage, the company reserves the right to cancel the respective order.
The user may choose a full refund of the amount paid, or the replacement of the product(s), with a refund or payment of the difference if the respective price is lower or higher than initially contracted.
The prices shown include all legally required taxes.
Order and Payment
The order is considered firm and accepted after confirmation is sent to the user via the registered email address, and it must contain all information about delivery, billing, payment conditions, and product specification and quantities.
In the absence of the aforementioned confirmation within a maximum period of 5 (five) days from the order date, the user must request it within the following 10 (ten) days, via email contact@vilabelawines.pt.
Any subsequent changes to the order are admissible before its shipment, provided they do not affect its execution.
Order cancellations are also admissible under the circumstances mentioned in the previous paragraph and through the same communication channels.
The execution and delivery of the order depend on prior payment, which must be made through Multibanco Reference and MBWay and in Euros.
In the event of the total or partial impossibility of executing the order, the company will contact the user to agree on its resolution or alteration and consequent refund or price adjustment.
Shipping Costs
The price will always include the shipping costs, which are calculated based on the transportation cost, taking into account the weight of the order and its delivery destination.
The shipping cost is automatically calculated when the order is presented and is subject to change depending on market conditions.
Shipments and Deliveries
Orders will be sent within the following estimated timeframes:
- 4 to 6 business days in Mainland Portugal;
- 15 business days in the archipelagos of Madeira and the Azores.
The shipment of orders can be monitored by the user through the link provided by the company.
After 15 (fifteen) days from the end of the above-mentioned deadlines, if the product(s) have not been delivered, the user must inform the company of this occurrence.
Upon delivery, the user will verify the conformity of the product(s) sent.
If the product(s) show non-conformity or damage, the user must return them to the carrier, justifying the reason for the return on the carrier’s delivery note and immediately notify the company, if possible with photographic evidence, and through the communication means mentioned above.
In case of a failed delivery attempt, the carrier will leave a notice of this fact in the user’s mailbox, and it is up to the user to contact the carrier to reschedule the delivery.
Returns
The user enjoys the rights recognized by law and, in particular, by Decree-Law No. 109-G/2021 and Decree-Law No. 84/2021, of December 10, 2021, provided that the product is presented with its original packaging and delivered accessories and accompanied by proof of purchase or invoice.
For the purpose of return, the user must use the communication means mentioned above, indicating the order number or the document that accompanied it.
Once the return is accepted, the company will refund the price to the user, using the same payment method the user used for the purchase.
The company is not responsible for non-conformities resulting from poor storage conditions or force majeure causes.
Applicable Law and Competent Court
Any disputes arising from the interpretation, application, and fulfillment of the Terms and Conditions provided in this document will be resolved according to Portuguese Law and by the territorially competent Portuguese Court.
Pursuant to and for the purposes of Article 18 of Law No. 144/2015, of September 8, it is informed that the Alternative Dispute Resolution entity available is the Consumer Conflict Arbitration Center of Porto, with the following contacts:
